These Terms of Use ("Terms") contain the legal terms and conditions that govern you use of the FireUpFlash website ("the Site"). By visiting the Site you agree to these Terms, and that you are bound by all applicable local laws. To the extent allowed by law, these Terms constitute a signed written agreement.
Availability
The service provided is on an 'as is' and 'as available' basis, with the rights to modify, suspend or discontinue the FireUpFlash service ("the Service") being reserved by FireUpFlash. You agree that FireUpFlash ("We") is in no way liable for any changes to or discontinuation of the Service

The Privacy Policy contains the full details of our information usage and forms part of these Terms.
Copyright
FireUpFlash is unless otherwise stated, the owner of all copyright and data rights in this Service and its contents. Users who have submitted work to the Site are either the copyright owners of all the component parts of their work or are submitting the work under license from the copyright owner(s) or as permitted by law.
FireUpFlash makes no claim to the ownership rights of work submitted to the Site by you (your Content). For the purpose of enabling us to make your Content available through our service, you grant FireUpFlash a non-exclusive, royalty free license to reproduce, distribute, reformat, store, prepare derivative works and publicly display your Content.
You are not allowed to reproduce, distribute, publicly display or create derivative works based on any content of the Site, unless you have the express written consent of the license holder. You also agree not to distribute any part of this Service, other than your Content, via any medium.
FireUpFlash licenses you to use the downloadable project FLA files as a basis your own works. These files are exempt from the conditions laid out in the preceding paragraph.
Copyright Violations
FireUpFlash takes the intellectual property rights of others seriously and we expect our users to do the same. We reserve the rights to remove content submitted to the Site, terminate the user accounts and prevent access to users we understand to have infringed upon the intellectual property rights of others.

You agree to defend, indemnify, and hold harmless FireUpFlash, its directors and its employees from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and expert fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.
Amendment of Terms
We reserve the rights to amend these terms as our Service evolves or as in necessary. If you are a registered member we shall notify of changes to these Terms via the email provided at registration. Non-registered members are required to review this page regularly as continued use of the Site will be considered an acceptance of these conditions in their current state.
Storage Policy
FireUpFlash provides free online storage for your Content to registered members. We reserve the right to limit the maximum size of files, maximum total size of files stored, and the length of time for which these files are stored. We also reserve the right to terminate inactive accounts and to make changes to our storage policy without notice. FireUpFlash shall have no responsibility or liability for the deletion or failure to store any content submitted to the Service. It is your responsibility to create backups of all your Content.
Conduct
You are responsible for all of your Content; it is up to you to ensure that it is not in contravention of these terms and conditions or any applicable laws.
You agree not to use the Service:
- for unlawful purposes;
- to upload, post or transmit content that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, vulgar, illegal or otherwise objectionable;
- to upload, post or transmit content that infringes upon any copyright, trademark, patent or intellectual property right;
- to harm minors in anyway;
- to upload, post or transmit content which is likely to cause damage to FireUpFlash or any users computer systems;
- for commercial purposes;
- to sell access to the service;
- to impersonate any person or entity;
- to attempt to gain unauthorized access to any part of the Service, including other users accounts;
- to collect email addresses for the purpose of unsolicited communications.
